The Department of
Labor has just released its final version of the new FLSA
regulations governing overtime eligibility for "white-collar"
workers. The final regulations are different in several key
respects from the regulations that the DOL proposed in March 2003.
Specifically, the final version of the regulations:

contains a rule
prohibiting classification of police officers, firefighters,
investigators and other "first responders" as exempt;

raises the salary
basis test to $455 per week;
-
increases the highly
compensated employee exemption threshold from $65,000 to
$100,000; and
-
largely reverses the
proposed changes to the administrative and professional
exemptions.
The regulations will
go into effect 120 days after they are published in the Federal
