The Department of Labor has just released its final version of the new FLSA regulations governing overtime eligibility for "white-collar" workers. The final regulations are different in several key respects from the regulations that the DOL proposed in March 2003. Specifically, the final version of the regulations:

  • contains a rule prohibiting classification of police officers, firefighters, investigators and other "first responders" as exempt;

  • raises the salary basis test to $455 per week;

  • increases the highly compensated employee exemption threshold from $65,000 to $100,000; and

  • largely reverses the proposed changes to the administrative and professional exemptions.
