If your agency provides cash payments to employees who opt-out of a health insurance plan, your agency should fully understand and evaluate the impact and (unintended) consequences cash in lieu may have.  The presentation will cover the basics of what constitutes cash in lieu under a cafeteria plan.  The audience will learn how cash in lieu affects the determination of whether health coverage is affordable to employees and how an agency can set up a health flex contribution and an eligible opt-out arrangement to make health coverage affordable under the Affordable Care Act.  This presentation will explain how cash in lieu impacts the regular rate of pay based on the Ninth Circuit’s decision in Flores v. City of San Gabriel.  The presentation will also describe alternatives to providing cash in lieu, including offering contributions to a deferred compensation plan or a government retirement plan.
