Understanding the Impact of Recent Department of Labor (DOL) Updates to the Regular Rate of Pay (San Francisco)

For the first time in over 50 years, the Department of Labor has issued new interpretations of the Fair Labor Standards Act’s regular rate requirements.  The new interpretations, are effective January 15, 2020.  All public employers must comply with the FLSA and its overtime and regular rate requirements.  This session will provide must-know information and clarification contained in the Department of Labor’s new regular rate rules.  A review of various types of compensation and what may and may not be excluded from the regular rate will be discussed, including holiday in lieu, wellness programs, cash in lieu of health benefits, lump sum bonuses, and sick leave buys backs.  Our expert presenters will help identify steps your agency should take to conduct a FLSA check-up and ensure compliance with the FLSA’s regular rate requirements. This session will also address how to address the DOL’s new rules in the collective bargaining context.

Liebert Cassidy Whitmore is an approved MCLE provider. Participating attorneys are eligible for 3.5 hours of MCLE. The person from your agency that registers for this webinar will receive the official set of MCLE forms. In order to receive your MCLE credit, you will need to complete and return these forms that will be available at the workshop.
