Employment Law

Employment law is a broad and complex area of practice impacting every aspect of the employer and employee relationship. We work closely with employers to provide advice in areas such as hiring applicants, wage and hour, discipline and performance, the disability interactive process, and retirement.

Much of our practice is devoted to advising agencies regarding compliance with the innumerable employment related laws and regulations. These include California’s Fair Employment and Housing Act, the 1964 Civil Rights Act, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Family and Medical Leave Act, the California Family Rights Act, the Fair Labor Standards Act, the Meyers-Milias-Brown Act, the Educational Employment Relations Act, the Public Records Act, and many others.

Areas in which we work

Pre-Employment

LCW provides counsel and advice through the pre-employment process, including applications, discrimination, background checks, criminal backgrounds, conditional offers, and pre-employment medical exams.  Members of our Public Safety Practice Group and can provide specialized advice when it comes to hiring employees into your police departments.

Personnel Issues

LCW provides counsel and advice to manage employee performance and discipline.  This includes performance evaluations, performance improvement plans, suspensions, demotions, and terminations. 

LCW can also assist your agencies through the disability interactive process.  Members of our Retirement, Health, and Disability Practice Group can provide the individualized advice necessary for disability matters.

Retirement

Liebert Cassidy Whitmore provides representation, advice, and counsel to employers on public employee retirement plans, health and welfare benefits, the Affordable Care Act, and issues related to employee disabilities, including disability retirement, the interactive process, reasonable accommodations, and employees on extended leave.

Administrative Proceedings

LCW has established a successful record of representing our clients in a wide spectrum of administrative hearings, including proceedings before arbitrators and hearing officers, fact finding and arbitration panels, personnel advisory boards, civil service commissions, retirement boards, the Public Employment Relations Board (PERB), state labor commissions, the California Unemployment Insurance Appeals Board (CUIAB), the Equal Employment Opportunity Commission (EEOC), and the Fair Employment and Housing Commission (FEHC).
