Personnel Policies / Employee Handbooks

Liebert Cassidy Whitmore has extensive experience preparing, revising and customizing personnel policies, administrative policies, and employee handbooks.  Our audit services draw on LCW’s legal expertise from representing employers in all aspects of labor and employment law. LCW closely monitors relevant labor and employment laws and regulations, which enables us to incorporate important developments in the law and best management practices into our analysis, recommendations, and revisions. Our audit services can provide a comprehensive audit of an employer’s entire personnel policies/employee handbook, or specific policies. 

In addition, LCW has developed several sets of model policies including the Liebert Model Personnel Policy Portal (LMP3) for public sector agencies, the Board Policy and Administrative Procedure Service for community college districts, and the sample Employer-Employee Relations Resolution/Ordinance that is widely utilized by public agencies throughout California.

Wage and Hour / Fair Labor Standards Act Audits

Liebert Cassidy Whitmore has extensive experience providing audits to employers to ensure compliance with wage and hour laws and best management practices.  Our audit services draw on our wide experience from representation of numerous employers in wage and hour / Fair Labor Standards Act (FLSA) litigation. LCW utilizes a methodical, problem-solving approach to conducting audits. The audit process includes a comprehensive investigation and analysis of written documents and actual practices within the organization, and practical recommendations to achieve compliance. Labor Agreement Audits

Liebert Cassidy Whitmore has extensive experience auditing labor agreements.  Our audit services draw on LCW’s legal expertise in wage and hour, retirement and health benefits, protected leaves, public employee rights, education laws, privacy laws, as well as a multitude of resources developed over years of experience negotiating labor agreements.  We help identify contract interpretation issues that may arise, and offer sound advice for clarifying vague or misleading contract language. Retirement and Benefits Audits

Liebert Cassidy Whitmore has extensive experience providing retirement system and benefits audits to ensure compliance with public retirement statutes, regulations and charter provisions.  LCW provides review and analysis on retirement system obligations (including enrollment), independent contractor status, retirement formulas, CalPERS optional contract benefits, disability retirement eligibility and procedures, reportable compensation, unfunded liabilities, elected official benefits, and post-retirement work restriction compliance. Affordable Care Act Audits

Liebert Cassidy Whitmore has extensive experience providing audits to employers to ensure compliance with the federal Patient Protection and Affordable Care Act (ACA).  LCW attorneys conduct a comprehensive review of an employer’s workforce and offered health plans to determine potential exposure to the ACA penalties. The audit includes a thorough review and analysis of the employer’s current practices, which includes interviews with select employees with knowledge about key areas that are relevant to ACA compliance.  LCW prepares a summary of findings, analysis, and recommendations where applicable.  This process and areas audited may be customized depending on the employer’s needs and goals. For more information on these services, please see our Affordable Care Act Practice page.

Human Resources and Management Audits
