Employment Law

Employment law is a broad and complex area of practice impacting every aspect of the employer and employee relationship.  We work closely with employers to provide advice in areas such as hiring applicants, wage and hour, discipline and performance, and the disability interactive process.

Much of our practice is devoted to advising agencies regarding compliance with the innumerable employment related laws and regulations. These include California’s Fair Employment and Housing Act, the 1964 Civil Rights Act, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Family and Medical Leave Act, the California Family Rights Act, the Fair Labor Standards Act, and many others.

Areas in which we work


LCW provides counsel and advice through the pre-employment process, including applications, discrimination, background checks, criminal backgrounds, conditional offers, and pre-employment medical exams.  

Personnel Issues

LCW provides counsel and advice to manage employee performance and discipline. This includes performance evaluations, performance improvement plans, suspensions, demotions, and terminations.

Administrative Proceedings

LCW has established a successful record of representing our clients in a wide spectrum of administrative hearings, including proceedings before arbitrators and hearing officers, fact finding and arbitration panels, personnel and civil service commissions, state labor commissions, the California Unemployment Insurance Appeals Board (CUIAB), the Equal Employment Opportunity Commission (EEOC), and the Fair Employment and Housing Commission (FEHC).

ACA Reporting Relief – Written Statement to Covered Individuals Now Due March 2, 2018; Good Faith Penalty Relief Extended

The Internal Revenue Service (IRS) has issued an automatic, 30-day extension for applicable large employers to furnish IRS Forms 1095-B and 1095-C to covered individuals.  For the 2017 reporting period, these forms are now due to individuals on March 2, 2018, rather than January 31, 2018.
