Carla McCormack Associate

Carla represents management on a full range of employment law issues, with particular expertise in preventive counseling, disciplinary and harassment investigations, disability accommodations/interactive process, and progressive discipline.

As a member of our Education Law group, Carla regularly advises our independent and public school clients on the range of issues they face. Carla has particular expertise on education issues relating to students including special education, Section 504, student health, student rights, and student discipline. She regularly provides advise and counsel regarding Education Code provisions related to students, and drafts Board Policies and Administrative Regulations on student issues for districts.

With respect to our independent school clients, Carla provides advice and counsel on student and employee issues. She drafts enrollment contracts and employment agreements, and provides advice and counsel regarding student health and student discipline including administration of medication, health plans, cyberbullying, privacy rights, and student internet use.

EEOC Removes Final Rules that Permitted Employers to Offer Incentives to Encourage the Disclosure of Health Information in Connection with an Employer Wellness Program

In December 2018, the Equal Employment Opportunity Commission (“EEOC”) removed Final Rules that permitted employers to offer incentives to encourage the disclosure of health information in connection with an employer wellness program.  This change is effective January 1, 2019.
