Private Education COVID-19 Exposure and Outbreak Compliance Policy and Notices
On September 17, 2020, Governor Newsom signed into law Assembly Bill (“AB”) 685, codifying in Labor Code section 6409.6 certain notice requirements where employees were potentially exposed to the virus that causes COVID-19 at an employer worksite or facility or where there is a workplace Outbreak of COVID-19 at a school worksite or facility. The requirements set forth in AB 685 became effective on January 1, 2021.
On November 19, 2020, the Occupational Safety and Health Standards Board (“OSHSB”) promulgated new Cal/OSHA regulations, including those related to notice requirements in the event of a potential workplace exposure and workplace COVID-19 Outbreaks. (8 C.C.R. § 3205-3205.2.) These statutory requirements became effective on November 30, 2020.
The CDPH also currently requires that employers report workplace COVID-19 Outbreaks to the Local County Public Health Department as provided for in the section of this Policy entitled, Notice to Local County Public Health Department in the Event of a Workplace COVID-19 “Outbreak”. Further, the CDPH “COVID-19 and Reopening In-Person Instruction Framework and Public Health Guidance for K-12 Schools in California, 2020-2021 School Year” available at https://www.cdph.ca.gov/Programs/CID/DCDC/CDPH%20Document%20Library/COVID-19/Consolidated_Schools_Guidance.pdf requires that schools notify the local health department of any known student or employee who tests positive for COVID-19 if the student or employee was present on the school’s campus within 10 days before they tested positive for COVID-19.
The documents contained in this packet include a COVID-19 reporting policy, and sample notices in order to assist Schools in complying with these requirements.
