SB 1172 – Creates Of The Student Test Taker Privacy Protection Act

Senate Bill 1172 (SB 1172) creates the Student Test Taker Privacy Protection Act imposing certain requirements on businesses that provide proctoring services, such as observing, monitoring, or administering an exam, in an educational setting.  These proctoring businesses are limited to only collecting, using, retaining, and disclosing the personal information strictly necessary to provide proctoring services.  We recommend that K-12 private schools confirm that any contracts they may enter into with businesses that provide proctoring services include an obligation that the businesses comply with the specific requirements of SB 1172.

(SB 1172 adds Section 22588 to the Business and Professions Code.)
