Former Police Officer v. City (2023) – A peace officer who was released on probation sued a city claiming that his release was an arbitrary and capricious government action that violated his substantive due process rights. Suzanne and Abby convinced the Ninth Circuit Court of Appeals to uphold the District Court’s dismissal of the case because the officer could not prove that the City took any specific action, such as a governmental “blacklist”, that excluded him from his chosen profession of law enforcement.
