Our audit services can provide a comprehensive audit of an employer’s entire personnel policies, administrative policies and personnel policies, or specific policies. The audit process includes a comprehensive investigation and analysis of written documents and actual practices within the organization, and practical recommendations to achieve compliance. Our audit services can provide a comprehensive examination of all aspects of wage and hour compliance, or tailor the audit to specific departments, classifications or suspected compliance problems.

 

The California Fair Pay Act prohibits pay differentials on the basis of gender and race. Our audit process includes a comprehensive review of personnel information and data; compensation data, and compensation policies and practices; and job descriptions and duties, in order to analyze and assess an organization’s compliance with the California Fair Pay Act and federal Equal Pay Act. Our audit services provide practical solutions to achieve compliance, and our audit process can be tailored to assess specific departments, classifications or positions.

 

 

Compliance with the federal Patient Protection and Affordable Care Act (ACA) is essential for organizations to avoid potential exposure to ACA penalties. The audit includes a thorough review and analysis of the employer’s current practices, which includes interviews with select employees with knowledge about key areas that are relevant to ACA compliance. Liebert Cassidy Whitmore has extensive experience conducting retirement system and benefits audits to ensure compliance with public retirement statutes, regulations, charter provisions, and applicable federal tax laws. We review both qualified and nonqualified retirement arrangements to help safeguard tax-favored status, strengthen administrative practices, and reduce fiduciary and financial risk.

Our analysis addresses a broad range of retirement system obligations, including employee enrollment, independent contractor determinations, retirement formulas, CalPERS optional benefits, disability retirement eligibility and procedures, reportable compensation, unfunded liabilities, elected official benefits, and post-retirement work restrictions. For 403(b), 401(k), Defined Benefit, and 457 plans, we also evaluate fiduciary governance structures, investment oversight processes, prohibited transaction concerns, reporting and disclosure requirements, and operational compliance with plan documents. In addition, we advise on the tax treatment of contributions and distributions and assist clients in identifying and correcting operational or reporting errors that may affect compliance or plan qualification.
