The disability retirement process can be long, challenging, and involve the intersection of multiple complex areas of law. This presentation will cover the entire disability retirement process from the initial injury through the certification and appeal process. The presentation will cover and explain how to coordinate the disability retirement process with disability leave laws and the workers’ compensation system, including the different legal standards that apply for substantial incapacity and industrial causation and when the employer should seek an independent medical examination. The presenters will use examples and case studies to provide practical examples and demonstrate the nuances and legal liability in this complex area of law.
