A traveling nurse alleged race discrimination, defamation, and due process violations against one of LCW’s hospital clients. The claims arose after the hospital reported concerns to the nurse’s staffing agency. Parents had repeatedly complained about the nurse’s handling of NICU infants, and the nurse had an unprofessional confrontation with the hospital’s supervisory staff. The staffing agency reassigned the nurse to another hospital, where he continued working at a higher rate of pay.
LCW prevailed at every stage of the nurse’s litigation in both federal and state courts. The federal court denied the nurse’s attempt to withdraw deemed admissions, granted summary judgment on the federal claim, and remanded the remaining state law claims. LCW then renewed the hospital’s motion for summary judgment in state court, successfully opposed the nurse’s untimely efforts to reopen discovery, and won summary judgment on the remaining claims.
