President Trump Issues Executive Order, “Ending Radical Indoctrination in K-12 Schooling”

On January 29, 2025, President Trump issued an Executive Order (EO) titled “Ending Radical Indoctrination in K-12 Schooling,” outlining policies to address ideological content in education.

Key Provisions

The EO directs the Department of Education, Department of Defense, and Department of Health and Human Services to develop a strategy to eliminate federal funding for K-12 curricula, programs, and teacher training that support what it deems “illegal and discriminatory treatment and indoctrination in K-12 schools, including based on gender ideology and discriminatory equity ideology.”

The EO defines “discriminatory equity ideology” as an “ideology that treats individuals as members of preferred or disfavored groups, rather than as individuals, and minimizes agency, merit, and capability in favor of immoral generalizations.”

The EO directs federal agencies to ensure compliance with Title VI (prohibiting race-based discrimination), Title IX (sex-based protections), the Family Educational Rights and Privacy Act (FERPA), and the Protection of Pupil Rights Amendment (PPRA).

The EO also directs the Attorney General to collaborate with state and local prosecutors to enforce laws against school officials who engage in unlawful medical practices, conceal information from parents, or promote “social transitions” (i.e., the process of “adopting a “gender identity” or “gender marker” that differs from a person’s sex”) without parental consent.

Application to K-12 Schools

Public schools and private schools that accept federal funding should carefully consider policies or practices that may be at risk for violating this EO.  For schools that do not receive federal funding, the EO may have limited applicability.
