SB 848: California expands child abuse prevention and hiring duties for private schools

LCW attorneys Julie L. Strom and Michael Blacher coauthored an article analyzing California’s enactment of SB 848, the School Employee Misconduct: Child Abuse Prevention Act. The law significantly expands abuse prevention, reporting, and hiring obligations for private schools beginning in 2026.

SB 848 expands child abuse prevention, reporting, and hiring requirements for California private schools, bringing them closer to public school standards starting January 1, 2026. The law broadens mandated reporter coverage, strengthens applicant screening and disclosure duties, and requires annual training and written boundaries policies by July 1, 2026. A statewide misconduct database is anticipated by July 1, 2027, but undefined standards and expanded disclosure obligations create compliance and liability risks for private schools.
