Pensionable compensation is an on-going hot topic in labor negotiations, and it can also be a complex issue. This session will identify the legal framework for determining pensionable compensation and identify common challenges agencies and labor negotiators face in structuring compensation to comply with the law. Recent court decisions and guidance from CalPERS necessitate reviewing the structure of compensation packages, particularly in the areas where hybrids (the combination of more than one pensionable pay are tied together) and the manner in which lump sum payments are provided. Understanding the impacts to “new members” under PEPRA is also important. With additional audits by CalPERS and compensation review for employees at the time of retirement, knowing how to ensure compliance with retirement rules and regulations regarding pensionable compensation is important.
