The New Landscape: 2023 Peace Officer Employment
Recent years have brought seismic changes to the law enforcement profession in California. Multiple Legislative actions have significantly altered the law governing peace officer employment, and agencies and officers will have to adjust accordingly. Experienced public safety attorneys Paul Knothe and Nathan Jackson will lead a thoughtful discussion of the new laws, focusing on the practical steps that agencies can take to avoid fault lines, from the hiring stage to the end of the employment relationship.
SB 2 dramatically transformed and expanded the role of the Commission on Peace Officer Standards and Training (POST), which is now effectively a licensing board with the ability to decertify officers, making them unemployable by an agency in the state. It also creates a new Peace Officer Standards Accountability Division, empowered to review agencies’ investigations of misconduct – or conduct its own – and a Peace Officer Standards Accountability Board to review those investigations and make recommendations to the Commission regarding suspension or decertification of officers.
SB 16 imposes new recordkeeping requirements and removes several Pitchess confidentiality from several categories of peace officer personnel records, continuing the trend away from Pitchess and toward transparency that SB 1421 started in 2019.
In addition, the discussion will cover:
- Increased minimum age a potential changes to minimum education requirements under AB 89
- Changes to peace officer job descriptions and screening of applicants for bias under AB 846
- Prohibition of “law enforcement gangs” under AB 958
- Mandatory reporting uses of force under AB 26
- Restrictions on use of crowd control uses under AB 48
- Hate crime policies under AB 57
- Prohibition of transport methods involving risk of asphyxia under AB 490
- Penalties for false statements in police reports under AB 750
- Rules for acquisition and use of military equipment under AB 481
Knothe and Jackson will walk the audience through complex scenarios that can arise under these new laws and explore the practical effects they will have on the decisions law enforcement leaders have to make.
